When should I upload and register my file(s)/media?
Ideally before you put it into the public domain but, failing that, as soon as possible afterwards - it's never too late to get registered!
How will your registration service help me?
If your copyright material is misused, copied or used in an unauthorised way then being able to show when it was created
helps your case.
One of the key issues in a copyright dispute is who produced the content first. We can provide you or your legal team with a copy of the original file and independent
corroboration of the exact date and time it was registered with us.
In most cases where copyright is breached, showing that you have the media registered with an organisation is enough for the other party to comply with your requests.
We also provide you with an example 'Cease and Desist' letter.
How can I prove copyright ownership?
To help prove ownership, you, as the author of any copyright material, would need to produce evidence of the creation of the original work and proof of authorship. Such evidence usually requires a date reference. You can arrange to deposit a copy with your bank or solicitor or use our service which is cheap, fast and easy.
What is a 'Cease & Desist' letter?
If you believe that your original copyright material has been infringed, you can send the infringer a 'Cease & Desist' letter. This requires them to remove/destroy any copies of the work in question and desist from future infringements. A full template with autofill is provided in the members area.
Should I apply for a Trademark?
You can register a logo or brand name with the Intellectual Property Office (IPO). There is a fee payable on application and it needs renewing every 10 years. Whilst your logo and brand name would be copyright when you design them, in our experience also registering them as a Trade Mark provides a greater level of protection. The cost to register a trademark starts at £170 (UK 2021)
If someone registers a domain name that breaches your trademark (eg using a similar name that could cause confusion) then, for .UK registered domains, you can use the Nominet Dispute Resolution Service.
You do have to pay for this service but if you are successful with your case then you can apply to the Small Claims Court to recoup your costs from the infringer. Again we recommend that you take legal advice (usually with a successful case your lawyer can ask the
judge to also award all legal costs as part of the settlement). To reduce your risk you could use a 'No Win-No Fee' lawyer.

How do I show that I have registered media with you?
For every file that you upload you will have access to a unique certificate of registration for that file. This is provided as a downloadable PDF.
You will also have access to website buttons (unique for each uploaded file) that you can place on your site, blog etc. They contain a link for visitors to check that the content is actually registered with us
(no personal information is displayed).
We can also send you printed copies of your certificates costing £2.49 for the first one (including P&P) and £1.25 for each additional certificate ordered at the same time.
Do you have any experience of infringement?
Sadly Yes! One of the problems of operating a successful company is that unscrupulous people will try to ride off the back of you and copy or imitate your hard work for their own gain.
We have used Cease and Desist letters, the Nominet Dispute Resolution Service, had our TradeMark infringed and used the Small Claims Court to claim costs and protect our interests - all were successful!
